Terms of Use

Last updated: October 29, 2026

These Terms are an agreement between you and Proc Technologies LLC ("Proc", "we", "us"). They cover the website at tryproc.com and the AI Skill Test and Level Up at app.tryproc.com (together, the "Service"). By ticking the box at sign-up or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

If you use Proc through your employer's Proc for Business program, the notice you were shown and your employer's agreement with us also apply. If they conflict with these Terms, the notice and that agreement control.

IMPORTANT: THESE TERMS INCLUDE AN ARBITRATION AGREEMENT, A JURY TRIAL WAIVER, AND A WAIVER OF YOUR RIGHT TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE OR OTHER REPRESENTATIVE ACTION (SECTION 10).

1. Who can use the Service

You must be at least 18 years old and live in the United States. You may have one account, and the information you give us must be true. We sign you in with a code sent to your email, so you are responsible for keeping that email secure and for activity on your account.

2. What the Service is

The AI Skill Test gives you short practice tasks to complete with a built-in AI assistant. It then gives you a score, a level, a percentile and coaching on how you prompted. Level Up adds three more skill levels and a final test.

3. Rules for using the Service

You shall not at any time, directly or indirectly:

  1. Type sensitive details about you or anyone else, such as health conditions, financial account numbers, government ID numbers or passwords, or anything confidential from your job.
  2. Use any score, leaderboard or group board to make or influence a decision about hiring, promoting, paying, disciplining or firing anyone, or require anyone to take the test or share a score as a condition of work.
  3. Copy, publish or sell our tasks, materials, scoring or coaching, or use them to build a competing product or to train an AI model.
  4. Use bots, scripts or scraping, share your account, try to get around limits or payment, or interfere with the Service or its security.
  5. Choose a nickname or group name that is offensive, misleading or someone else's, or break the law or anyone's rights when using the Service.
  6. License, sublicense, assign, sell, rent, lend, lease, distribute, transmit, host, outsource, disclose or otherwise commercially exploit or make available the Service.
  7. Reverse engineer, disassemble, decompile, decode, adapt, or otherwise attempt to derive or gain access to any software component of the Service, in whole or in part.
  8. Remove any proprietary notices from the Service.
  9. Use the Service in any manner or for any purpose that infringes, misappropriates or otherwise violates any intellectual property right or other right of any person, or that violates any applicable law or regulation.
  10. Use the Service to exploit, harm, or attempt to exploit or harm minors in any way, including by exposing them to inappropriate content.
  11. Use the Service to unlawfully impersonate or attempt to impersonate Proc, a Proc employee, another user, or any other person or entity.
  12. Use the Service in any way that is illegal, threatening, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.
  13. Engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by Proc, may harm or offend Proc or users of the Service or expose them to liability.
  14. Generate offensive sexual, religious or political content.
  15. Use any robot, spider or other automatic device, process or means, or any manual process, to access, monitor or copy any of the material on the Service without our prior written consent.
  16. Use any device, software or routine that interferes with the proper working of the Service, or introduce any viruses, trojan horses, worms, logic bombs or other material that is malicious or technologically harmful.
  17. Attempt to gain unauthorized access to, interfere with, damage or disrupt any part of the Service, the server on which it is stored, or any server, computer or database connected to it, or attack the Service through a denial-of-service or distributed denial-of-service attack.

You are responsible and liable for all uses of the Service resulting from access to and use of your account, directly or indirectly, whether permitted by or in violation of these Terms, including all acts and omissions that would constitute a breach of these Terms.

Proc reserves all rights not expressly granted in these Terms. Except for the limited rights expressly granted in these Terms, nothing in them grants, by implication, waiver, estoppel or otherwise, to you or any third party any intellectual property right or other right, title or interest in or to the Service.

Suspension. Notwithstanding anything to the contrary in these Terms, Proc may temporarily suspend your access to any part or all of the Service if: (i) Proc reasonably determines that (A) there is a threat to or attack on any of Proc's systems or intellectual property; (B) your use of the Service disrupts or poses a security risk to the Service or to any other customer or vendor of Proc; or (C) you are using the Service for fraudulent or illegal activities; or (ii) Proc's provision of the Service is prohibited by applicable law; or (iii) any vendor of Proc, including OpenAI, has suspended or terminated Proc's access to any third-party service needed to provide the Service (each, a "Service Suspension"). If a Service Suspension continues for fifteen (15) business days or more, you may end these Terms. Proc shall use commercially reasonable efforts to give you written notice of any material Service Suspension, to provide updates on resumption, and to resume the Service as soon as reasonably possible after the cause is cured. Proc will have no liability for any damage, liability, loss (including any loss of data or profits) or other consequence you may incur as a result of a Service Suspension.

We may remove names or content, limit use, or suspend or close accounts that break these rules.

4. Leaderboard, groups and sharing

These features are optional, and Proc shall have no liability whatsoever related to your choice to use them. If you join the public leaderboard, your nickname, score and level are public. If you start or join a group competition, the name you enter and your score are visible to everyone who has the group's link. If you share a score link, anyone with it can see your nickname, score and level. You can leave the leaderboard at any time in your account. We may remove or change any nickname or group name.

5. Paid features and refunds

6. Your content and our content

Yours. You keep ownership of what you type. You give us permission to store it, send it to our service providers to produce replies and scores, show it back to you, and review it to fix problems and improve our tasks, scoring and coaching. We delete your prompts, the AI's replies, your answers and your coaching 30 days after each test.

Combined statistics. We may create statistics that combine many people's results and contain nothing that identifies you. They may include counts of how people worked, such as how many follow-up questions they asked, and how scores change from the first test to the final test. They never include your prompts or answers. We may use, publish and sell those statistics, including after your account is closed. The Privacy Policy sets out the limits we put on them.

Feedback. If you send us ideas or feedback, we may use them without owing you anything.

Ours. The Service and related documentation, including the contents of Proc's website and all related features and functionality (including all information, software, text, displays, images, video and audio, and their design, selection and arrangement), are owned by Proc, its licensors or other providers of that material, and are protected by United States and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. The material may not be copied, modified, reproduced, downloaded or distributed in any way, in whole or in part, without Proc's express prior written permission, except as these Terms expressly provide. Any unauthorized use is prohibited. Other companies' product names appear only to describe tasks. Proc is not affiliated with or endorsed by those companies.

Links to other websites. These Terms apply only to the Service. The Service may link to websites that Proc does not operate or control. We are not responsible for their content, accuracy, legality or any other aspect of them, and we do not check them. Proc has no liability to you or anyone else for any third-party website or service. When you follow a link away from the Service, these Terms no longer apply, and your use of the other website is subject to its own terms and policies, which may include its own cookies or other ways of collecting information about you. You use third-party websites entirely at your own risk.

7. Modifying, updating and ending the Service

Proc reserves the right to modify, suspend or change the Service (or any feature of it), with or without notice and without liability to you.

Proc may from time to time provide enhancements or improvements to the Service, which may include patches, bug fixes, updates, upgrades and other modifications ("Updates"). Updates may modify or delete certain features or functions of the Service. You agree that Proc has no obligation to provide any Updates or to continue to provide any particular feature or function. All Updates are part of the Service and subject to these Terms.

You may stop using the Service at any time and ask us to delete your account by emailing support@tryproc.com. As described above, we may suspend or close your account if you break these Terms, if the law requires it, or if we end the Service. Sections 2, 3, 6 and 8 to 11 continue to apply afterwards.

Deleting your account. Deleting your account removes your email, nickname, scores, choices and any test content still on file, as described in our Privacy Policy. This cannot be undone, so save anything you want to keep first. Some records stay: payment records we must keep for tax purposes, deleted data in our hosting provider's encrypted backups for about a week, and combined statistics, which are not linked to you. Our service providers may also keep copies for a limited time under their own retention schedules: for example, our AI provider keeps copies of what you typed for up to 30 days, and our payment provider keeps payment records as the law requires.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND DEFECTS, AND WITHOUT WARRANTY OF ANY KIND. To the maximum extent permitted under applicable law, Proc, on its own behalf and on behalf of its affiliates and its and their licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limiting the foregoing, Proc makes no warranty or representation of any kind that the Service will meet your requirements, achieve any intended results, be compatible or work with any other software, systems or services, operate without interruption, meet any performance or reliability standards, or be error-free, or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither Proc nor any of its providers makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Service, or the information, content and materials included in it; (ii) that the Service will be uninterrupted or error-free; (iii) as to the accuracy, reliability or currency of any information or content provided through the Service, including AI output and scores; or (iv) that the Service is free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

Some jurisdictions do not allow the exclusion of or limitations on implied warranties, or limitations on the applicable statutory rights of a consumer, so some or all of the above exclusions and limitations may not apply to you.

9. Indemnity and limit of liability

You agree to indemnify and hold Proc and its parents, subsidiaries, affiliates, officers, employees, agents, partners and licensors (if any) harmless from any claim or demand, including reasonable attorneys' fees, due to or arising out of your: (a) use of the Service, including the creation, use, dissemination or modification of any text or other content; (b) violation of these Terms or any law or regulation; or (c) violation of any right of a third party.

TO THE FULLEST EXTENT THE LAW ALLOWS, PROC AND ITS OWNERS, OFFICERS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR OPPORTUNITIES. OUR TOTAL LIABILITY FOR ALL CLAIMS ABOUT THE SERVICE IS LIMITED TO THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. Some states do not allow some of these limits, so they may not apply to you.

10. Disputes

Talk to us first. Before starting any claim, email support@tryproc.com with the subject "Dispute" and a description of the problem. Both sides will try to resolve it informally for 60 days. If the dispute is not resolved within 60 days, you or Proc may start arbitration.

Limitations period. YOU AND PROC AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICE MUST BE STARTED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, IT IS PERMANENTLY BARRED.

Arbitration, class action and jury trial waiver. EXCEPT AS THESE TERMS OTHERWISE PROVIDE, YOU AGREE THAT ALL DISPUTES BETWEEN YOU AND PROC WILL BE RESOLVED BY BINDING INDIVIDUAL ARBITRATION, AND THAT YOU WAIVE YOUR RIGHT TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE OR OTHER REPRESENTATIVE ACTION.

Jury trial and class action waiver. IF FOR ANY REASON A DISPUTE PROCEEDS IN COURT RATHER THAN IN ARBITRATION, EACH PARTY IRREVOCABLY WAIVES, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ANY RIGHT IT MAY HAVE TO A TRIAL BY JURY IN ANY LEGAL PROCEEDING DIRECTLY OR INDIRECTLY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE (WHETHER BASED ON CONTRACT, TORT OR ANY OTHER THEORY), UNLESS SUCH WAIVERS ARE UNENFORCEABLE. You may resolve Disputes with Proc only on an individual basis, and may not bring a claim as a plaintiff or class member in a class action, class-wide arbitration, or consolidated or representative action. The arbitrator may award declaratory or injunctive relief only in your favor as an individual, and only to the extent needed to provide relief warranted by your individual claim.

Severability of this section. If any part of this section 10 is found by a court to be inapplicable or invalid, the rest of it stays in full force. If any other provision of these Terms is inconsistent with this section 10, or would change or make any part of it unenforceable, that provision is void and this section 10 controls.

Release. IF YOU LIVE IN A JURISDICTION THAT REQUIRES A SPECIFIC STATEMENT REGARDING RELEASE, THE FOLLOWING APPLIES. FOR EXAMPLE, CALIFORNIA RESIDENTS MUST, AS A CONDITION OF THESE TERMS, WAIVE THE APPLICABILITY OF CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY." YOU WAIVE THIS SECTION OF THE CALIFORNIA CIVIL CODE AND ANY SIMILAR PROVISION IN LAW, REGULATION OR CODE THAT HAS THE SAME INTENT OR EFFECT.

Governing law and courts. These Terms and all Disputes are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any claim that goes to court will be heard in the state or federal courts in Hillsborough County, Florida.

11. General
